- This Dining Program is brought to you by Visa in association with the participating establishments. Kotak Mahindra Bank Limited ("Bank") shall not be responsible or liable in any manner whatsoever for any deficiency or inadequacy of service rendered by any of the participating restaurants/dining establishments.
- The Visa Dining Program (consisting of card privileges at various participating restaurants/dining establishments, as set out in Annex 1 below) is open for participation to all Kotak Visa Platinum and Signature Credit Cardholders (“Cardholder”). To qualify for the privileges, all payments must be made in full with a valid Kotak Visa Platinum or Kotak Signature Credit Card.
- The validity period for the Visa Dining Program (except Marriott Hotel offers) is 15th April 2011 to 31 March 2012. Marriott Hotels’ offers are valid up to 30th September 2011
- Visa reserve the right to cancel, suspend or amend the Visa Dining Program (or any of the offers under the Visa Dining Program) without prior notice and without assigning any reason whatsoever, and without any liability on the part of Visa in relation to any such cancellation, suspension or amendment.
- Cardholders are not bound in any manner to participate in the Visa Dining Program. Any participation shall be voluntary and all participants understand, acknowledge and agree that all the offers made under the Visa Dining Program are purely on a best effort basis. Cardholder can also make transactions at the participating establishments without participating in the Visa Dining Program or availing the offers.
- Any Cardholder who utilizes, participates in, or attempts to utilize or participate in the Visa Dining Program, irrevocably agrees* to the following:
- Dining at any of the participating establishments is at the Cardholder’s own risk;
- The Bank and Visa shall not be responsible for, nor does it guarantee the quality of food, dining and other services provided by any of the participating establishments;
- The Bank and Visa will not be liable for any reason whatsoever for any claim for loss, damage howsoever incurred in relation to the use (or attempted use) of any of the food, dining or any other services at any of the participating establishments; and accordingly, the customer will not make any claim against the Bank / Visa for the foregoing
- The Bank and Visa make no guarantee or warranty that any of the benefits or privileges under the Visa Dining Program will be fulfilled. Accordingly, Cardholders shall not make any claim or seek compensation against Visa in relation to any loss, damage, expense suffered in relation to non fulfillment of any benefits or privileges under the Visa Dining Program for any reason whatsoever.
*For the avoidance of doubt, the agreement by the Cardholder is for reinforcement purposes only and does not in any way imply that Visa / Bank would otherwise be liable in the absence of such agreement
- The benefits and privileges offered in the Visa Dining Program:
- Are non-transferable and cannot be exchanged for cash or any other merchandise
- Cannot be used in conjunction with any other promotions, discounts, coupons or special offers.
- Cannot be clubbed with any other offers/ promotions
- Cardholders should make prior bookings before availing the benefits/privileges under the Visa Dining Program to ensure availability at the relevant participating establishment. Booking phone numbers are provided against each participating dining establishment
- Each benefit/privilege under the Visa Dining Program may be subject to additional terms and conditions imposed by the relevant participating establishment. Cardholders are solely responsible for checking and complying with such terms and conditions in addition to those stated in these terms and conditions.
- The Visa Dining Program, and these terms and conditions, shall be governed by the laws of India and any dispute arising out of or in connection with the Visa Dining Program and/or these terms and conditions shall be subjected to the exclusive jurisdiction of the courts in Mumbai.
